Article 1 - Definitions

  1. Additional agreement:an agreement whereby the customer acquires products, digital content and / or services in connection with a distance contract and these items, digital content and / or services are provided by Proud Today or by a third party on the basis of an agreement between that third party and Proud Today
  2. Reflection time:the period within which the customer can make use of his right of withdrawal;

  6. Duration agreement:an agreement that extends to the regular delivery of goods, services and / or digital content during a certain period;

Article 3 - Applicability

  1. These general terms and conditions apply to every offer from Proud Today and to every distance contract concluded between the entrepreneur and the customer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the customer. In addition, the conditions are included on the Proud Today website and are accessible to everyone. On request we will send you a written copy.
  3. If the distance contract is concluded electronically, by way of derogation from the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the customer electronically in such a way that they can be can be easily stored on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be inspected electronically and that they will be sent free of charge electronically or otherwise at the request of the customer.
  4. In the event that specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply mutatis mutandis and the customer can always rely on the applicable provision that is most favorable to him in case of conflicting conditions .

Article 4 The offerd

  1. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
  2. The offer contains a complete and accurate description of the products, digital content and / or services offered. The description is sufficiently detailed to enable the customer to make a proper assessment of the offer. If Proud Today uses images, these are a true representation of the products, services and / or digital content offered. Obvious mistakes or errors in the offer are not binding for Proud Today.
  3. Each offer contains such information that it is clear to the customer what rights and obligations are attached to accepting the offer. Proud Today reserves the right to make changes to the offer and the content at any time.

Article 5-The agreement

  1. Subject to the provisions of paragraph 4, the agreement is concluded at the time of acceptance by the buyer of the offer and compliance with the corresponding conditions.
  2. If the customer has accepted the offer electronically, Proud Today will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by Proud Today, the customer can dissolve the agreement.
  3. If the agreement is concluded electronically, Proud Today will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment. If the customer can pay electronically, Proud Today will observe appropriate security measures.

Article 6 Right of withdrawalt

Supplements:

  1. The customer has the right to cancel the order up to 14 days after receipt without giving any reason, provided that the seal has not been broken. When the seal is broken, the order is final and can no longer be returned. If the customer makes use of his right of withdrawal, the customer has another 14 days after cancellation to return the product.
  2. The customer will then be credited with the full order amount excluding shipping costs. Only the costs for returning from home to the webshop are for your own account. Article 7 Pricesn

Article 8 - Warranty and conformity

  2. An arrangement offered by the entrepreneur, manufacturer or importer as a guarantee does not affect the rights and claims that the consumer can assert towards the entrepreneur with regard to a shortcoming in the fulfillment of the obligations of the entrepreneur towards the entrepreneur on the basis of the law and / or the distance contract.
  3. The customer is obliged to check the delivered goods immediately upon receipt. If it appears that the delivered item is incorrect, inadequate or incomplete, then the customer must immediately report these defects by email to Proud Today before proceeding to return it to Proud Today. Any defects or incorrectly delivered goods must be reported to Proud Today by email immediately after delivery. Article 9 - Delivery and implementation

  1. Delivery takes place while stocks last.
  2. Orders placed before 5 pm will be shipped the next working day, if in stock. If an ordered product is not in stock, Proud Today will notify the customer as soon as possible. The customer then has the right to cancel the order.
  3. Delivery of the programs takes place after payment has been credited to the Proud Today account number.

Article 10 - Duration transactions: duration, cancellation and extension

  1. The continuing performance agreement that extends to the regular delivery of and access to products or services is entered into for the agreed contract term and cannot be canceled in the interim. The contract duration of a coaching plan is 12 weeks, 24 weeks or 48 weeks.
  2. After the expiry of your continuing performance agreement, your contract will automatically be terminated, unless you have extended yourself.

Article 11 - Payment

  1. When ordering the 12-week online program and the 'face-to-face' 12-week program, you pay the full amount in advance.
